Inflatable Waterpark Waiver and Release of Liability
INFLATABLE WATERPARK WAIVER AND RELEASE OF LIABILITY
THIS IS A LEGAL DOCUMENT. PLEASE READ IT CAREFULLY BEFORE SIGNING.
In consideration of being allowed to participate in activities at the inflatable waterpark located at Landings Campground, I, the undersigned participant (or parent/legal guardian if the participant is a minor), hereby acknowledge and agree to the following terms:
Assumption of Risk
I understand that participation in inflatable waterpark activities, including but not limited to, jumping, climbing, sliding, swimming, and other activities on or around the inflatable structures located in or around the pond, involves inherent risks and hazards that may result in serious injury, including but not limited to drowning, falls, collisions, or other injuries. I fully understand the risks involved and choose to participate voluntarily.
Health and Fitness
I confirm that I am in good health and have no medical condition that would prevent me from participating in the activities at the waterpark. If I have a known medical condition or disability, I have consulted with my doctor and received clearance to participate in these activities. I understand that I am responsible for ensuring that I am physically able to safely engage in waterpark activities.
Release of Liability
I, for myself, my heirs, assigns, and legal representatives, hereby release, waive, discharge, and agree not to sue Landings Campground Ltd., its owners, operators, employees, volunteers, or any affiliates, for any and all claims, injuries, losses, or damages arising out of or in connection with my participation in the inflatable waterpark activities, including any claims based on negligence or fault.
Indemnification
I agree to indemnify and hold harmless Landings Campground Ltd., its owners, operators, employees, volunteers, or any affiliates, from any and all claims, actions, losses, liabilities, damages, or expenses (including attorney’s fees) resulting from my participation in the inflatable waterpark activities, including any injury caused by my actions or the actions of others.
Use of Personal Equipment
I acknowledge that wearing a life vest or other personal flotation device (PFD) is recommended, and I am aware that I may be required to wear one while engaging in certain activities. I am responsible for ensuring that I wear appropriate attire and equipment while participating, and I understand that the inflatable waterpark may not provide all the equipment required.
Rules and Safety Guidelines
I agree to comply with all rules, regulations, and safety guidelines provided by Landings Campground Ltd., including instructions from employees or volunteers at the waterpark. I understand that failure to follow the rules may result in my removal from the activities, without refund, at the discretion of the staff.
Minors
If I am signing this waiver on behalf of a minor, I hereby consent to their participation in the inflatable waterpark activities and acknowledge that I am fully responsible for their safety and well-being. I further agree that I will be present to supervise the minors at all times during their participation in the activities.
Photo/Video Release
I consent to the recording of my image, voice, and/or likeness through photographs or video taken during my participation in the inflatable waterpark activities. I grant Landings Campground Ltd. permission to use these recordings for promotional or commercial purposes without compensation to me.
Severability
If any provision of this waiver is found to be unenforceable, the remainder of the waiver will remain in full force and effect.
Governing Law
This waiver shall be governed by and construed by the laws of Ontario, and any legal action arising out of or in connection with this waiver shall be filed in Canada.
Right to Refuse or Remove Guests
For the safety and enjoyment of all guests, Landings Campground reserves the right to refuse entry to or remove any individual from the premises at any time, without refund, for engaging in roughhousing, unsafe behaviour, failure to follow the rules or staff instructions, or for any other reason deemed necessary by management.
